General Terms and Conditions
§ 1 Applicability, Definitions
(1) WM aquatec GmbH & Co.KG, WM aquatec GmbH & Co.KG, Uracher Straße 22, 73268 Erkenbrechtsweiler, Germany (hereinafter: “we” or “WM aquatec GmbH & Co.KG Online Shop”) operates an online store for goods under the website https://wm-aquatec.de. The following General Terms and Conditions (GTC) apply to all services between us and our customers (hereinafter: “Customer” or “you”) in their version valid at the time of the order, unless expressly agreed otherwise.
(2) A “Consumer” within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. (1) The following provisions on contract formation apply to orders placed via our online shop at https://wm-aquatec.de.
(2) Our product descriptions on the website are non-binding and do not constitute a binding offer to conclude a contract.
(3) The following rules apply when an order is received in our online shop: The Customer submits a binding contractual offer by successfully completing the order process in our online shop. The order process consists of the following steps:
– Selection of the desired product,
– Adding the product(s) by clicking the corresponding button (e.g., “Add to Cart”),
– Reviewing the items in the shopping cart,
– Accessing the order summary by clicking the corresponding button (e.g., “Proceed to Checkout”),
– Entering/checking address and contact details, selecting payment method, confirming the GTC and cancellation policy,
– Completing the order by clicking the “Purchase Now” button. This constitutes your binding order.
The contract is formed when we send you an order confirmation via email to the provided email address within three business days.
(4) Upon contract formation, the contract is concluded with WM aquatec GmbH & Co.KG, Uracher Straße 22, 73268 Erkenbrechtsweiler, Germany.
(5) Prior to placing the order, the contract data can be printed or saved electronically using the browser’s print function. The processing of the order and transmission of all information required for the contract conclusion, including order details, GTC, and cancellation policy, will be sent via email after you submit your order, partly automated. We do not store the contract text after conclusion.
(6) Input errors can be corrected using standard keyboard, mouse, or browser functions (e.g., the browser’s “Back” button). You may also correct errors by canceling the order process, closing the browser window, and restarting the process.
(7) Order processing and transmission of all contract-related information occur via email, partly automated. You must ensure that the email address provided to us is correct, that emails are technically received, and that delivery is not blocked by SPAM filters.
§ 3 Subject Matter of the Contract and Key Product Features
(1) The subject matter of our online shop is:
– The sale of goods. The specific goods offered can be found on our product pages.
(2) The key features of the goods are described in the product details.
(3) For digital products, the restrictions evident from the product description or circumstances (e.g., hardware/software requirements) apply. Unless otherwise agreed, the contract grants the right to private and commercial use of the products, excluding resale or sublicensing.
§ 4 Prices, Shipping Costs, and Delivery
(1) The prices and shipping costs stated in the offers are total prices and include all components, including applicable taxes.
(2) The purchase price is due prior to product delivery (advance payment), unless expressly offered as “purchase on invoice.” Available payment methods are indicated under a designated button in the online shop or offer. Unless otherwise specified, payment claims are due immediately.
(3) Shipping costs may apply unless the product is marked as “free shipping.” Shipping costs will be clearly displayed on product pages, in the shopping cart, and on the order summary.

§ 5 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.
(2) We retain ownership of the goods until full payment of the purchase price is received.
§ 6 Right of Withdrawal
Consumers have a right of withdrawal. This is governed by our Cancellation Policy.
§ 7 Liability
(1) Our liability for contractual breaches and tort is limited to intent or gross negligence, except as stated below.
(2) We are fully liable for slight negligence in cases of injury to life, body, health, or breach of essential contractual obligations. For slight negligence causing delay, impossibility of performance, or breach of essential obligations, liability for material or financial damages is limited to foreseeable, typical contractual damages. Essential obligations are those enabling proper contract execution, whose breach jeopardizes the contract’s purpose, and which you may reasonably rely on. This includes our obligations under § 3.
§ 8 Contract Language
The contract language is exclusively German.
§ 9 Warranty
(1) Warranty claims are governed by statutory provisions.
(2) For Entrepreneurs, the warranty period for goods is 12 months.
(3) Consumers must inspect goods/digital products upon delivery for completeness, obvious defects, or transport damage and notify us or the carrier promptly. Failure to do so does not affect statutory warranty rights.
§ 10 Final Provisions/Dispute Resolution
(1) German law applies. For Consumers, this choice of law does not deprive them of mandatory protections under their country of residence (principle of favorability).
(2) The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
(3) For disputes involving Entrepreneurs, legal entities under public law, or public funds, the provider’s registered seat is the exclusive jurisdiction.
